📄 Data Processing Agreement (DPA)

This Data Processing Agreement ("DPA") forms part of the Terms of Use, Privacy Policy, and any other agreement between you (the “Customer”) and Game Plan Your Future, LLC, operating as TeacherCareerChanger.com ("Processor", “we”, “our”, or “us”).

This DPA is intended to ensure compliance with Article 28 of the EU General Data Protection Regulation 2016/679 (“GDPR”) for the processing of personal data.

1. Scope and Applicability

This DPA applies where we, as a Processor, process Personal Data on your behalf as part of providing services through TeacherCareerChanger.com, including but not limited to:

  • Membership site access

  • Digital courses

  • Coaching calls

  • Webinars

  • Forms, lead magnets, and opt-ins

You are the Data Controller of any personal data submitted or collected through our services.

2. Nature and Purpose of Processing

We process Personal Data to provide services including:

  • Hosting courses and coaching calls

  • Managing membership access

  • Sending emails and marketing communications (with consent)

  • Responding to support requests

  • Analytics and performance improvement

Processing is strictly limited to the scope necessary to deliver these services.

3. Categories of Data Subjects

The personal data processed relates to:

  • Teachers and education professionals

  • Website users who opt-in to receive content or register for offers

  • Customers who purchase services from us

4. Types of Personal Data Processed

We may process the following categories of data:

  • Name, email, and address

  • Phone number (if provided)

  • Payment data (via third-party processor only)

  • IP address and browser data

  • Course participation and engagement data

  • Communication history and submitted forms

We do not process any special category or sensitive data.

5. Obligations of the Processor (Us)

We agree to:

  • Process data only on documented instructions from you (as Controller)

  • Ensure confidentiality among authorized personnel

  • Take appropriate technical and organizational measures to protect data

  • Assist you in responding to data subject requests

  • Assist with security, breach notification, and compliance obligations

  • Delete or return personal data after service completion

  • Provide audit cooperation upon written request

6. Subprocessors

We may use subprocessors to deliver our services, including:

  • ThriveCart (checkout and affiliate management)

  • Kajabi or other course platforms (membership/course hosting)

  • ActiveCampaign or ConvertKit (email automation)

  • Stripe or PayPal (payment processing)

  • Meta/Facebook and Google (marketing tools)

We ensure all subprocessors comply with GDPR obligations through written agreements.

7. International Data Transfers

All data is stored and processed in the United States. By using our services, you acknowledge and agree to the transfer of data outside the EEA to jurisdictions with appropriate safeguards under GDPR.

8. Security Measures

We implement industry-standard measures such as:

  • SSL encryption

  • Password-protected accounts

  • Limited internal access controls

  • Regular data backups

  • Secure API integrations with third-party processors

9. Breach Notification

In the event of a data breach affecting your Personal Data, we will notify you without undue delay and provide all required information to help you fulfill your legal obligations under GDPR Articles 33 and 34.

10. Term and Termination

This DPA remains in effect as long as we process personal data on your behalf. Upon termination of our services, we will delete or return all Personal Data unless legal retention is required.

11. Governing Law and Jurisdiction

This DPA is governed by the laws of the State of Ohio, United States. Disputes will be handled in the jurisdiction outlined in our Terms of Use.
